Terms of use

By registering and/or using the web application eBiblioteka (hereinafter: "the Application"), You (hereinafter: "the User") agree to these Terms of Use (hereinafter: "the Terms").

These Terms constitute a legally binding agreement between the User and Ларко Дигитал ДООЕЛ Берово (hereinafter: "the Service Provider"), with registered office at ул. Маршал Тито бр. 114, 2330 Берово, ЕДБ: 4001022506340, ЕМБС: 7605137/1.

If you do not agree with these Terms, please do not use the Application. Use of the Application after the publication of amendments to the Terms shall be deemed acceptance of such amendments.

The User must be an authorized representative of the school (principal or a person authorized by the principal) to register and use the Application on behalf of the school.

eBiblioteka is a cloud-based web application (SaaS) for school library management that enables:

• Records of the library collection (books, required readings, periodicals)
• Textbook records by student and grade
• Digital book lending and returns
• Member records (students and teachers)
• QR code membership card generation
• Group textbook distribution by class
• Automatic generation of reports for the Ministry of Education
• Notification and reminder system
• Multiple levels of user access (administrator, librarian, teacher, student)

The Application is accessible through a web browser at subdomain.ebiblioteka.mk, where subdomain is a unique identifier assigned to each school upon registration.

The Service Provider reserves the right to add, modify, or remove features from the Application, whereby significant changes will be communicated to the User in advance.

The Service Provider currently offers a free usage period for the Application lasting 12 (twelve) months from the date of activation of the user account.

During the free period:

• The User has full access to all features of the Application.
• There is no limitation on the number of end users (students, teachers, librarians).
• No payment information is required.
• All conditions of these Rules regarding privacy, security, and data protection apply in full.

After the free period expires:

• The User will receive an offer to continue usage with a paid license.
• If the User does not enter into a paid usage agreement, access to the Application will be restricted (read-only, no new records) for a period of 30 days, during which the User may download all of their data.
• After the expiration of the 30-day period without an agreement, the Service Provider has the right to delete the User's data, subject to prior written notice.

The Service Provider reserves the right to change the duration of the free period or to discontinue it for new registrations, whereby already commenced free periods will be honored until their expiration.

To use the Application, the school must register through the registration form at registracija.ebiblioteka.mk.

Upon registration, the User undertakes to:

• Enter accurate and complete information about the school.
• Be an authorized representative of the school (principal or authorized person).
• Provide a valid email address for communication.

User Accounts

• After registration, the Service Provider will create an administrator account and deliver the access credentials to the school's email address.
• The school administrator is responsible for creating and managing additional user accounts (librarians, teachers, students).
• The User is responsible for maintaining the confidentiality of usernames and passwords and must take reasonable measures to prevent unauthorized access.
• In case of suspected unauthorized access, the User must immediately notify the Service Provider.

The User has the right to:

• Use the Application for the internal needs of the school library.
• Create an unlimited number of user accounts for employees and students.
• Download their data at any time.
• Receive technical support in accordance with these Terms.

The User undertakes to:

• Use the Application conscientiously, in accordance with its purpose and the usage guide.
• Not use the Application for unlawful purposes or in a manner that could damage, disable, or overload it.
• Ensure the accuracy and lawfulness of all data entered.
• Have an appropriate legal basis for entering personal data of students and teachers (consent, legal obligation).
• Not perform reverse engineering, decompilation, disassembly, or creation of derivative works from the Application.
• Not copy, distribute, or resell access to the Application.
• Notify the Service Provider of any problems or errors in the Application.

The Service Provider undertakes to:

• Enable access and use of the Application no later than 3 business days from registration.
• Ensure the functionality of the Application and its availability (minimum 99% uptime on an annual basis, excluding scheduled maintenance).
• Provide technical support via phone and email during business hours (Mon-Fri, 09:00-17:00).
• Perform regular maintenance, backups, and security updates.
• Protect the User's data in accordance with the Privacy Policy and applicable legislation.
• Notify the User of planned downtime due to maintenance.
• Deliver a usage guide (PDF guide) and introductory support.

The Service Provider has the right to:

• Suspend the User's access if it determines misuse, a security threat, or a violation of these Terms, upon prior notice.
• Add new features and perform upgrades to the Application.
• Perform scheduled maintenance with prior notice.

All data and content entered by the User into the Application remain the property of the User. The Service Provider has no ownership rights over this data.

The Service Provider:

• Will not use the User's data for its own purposes, marketing, or sale to third parties.
• Will process the data exclusively for providing the service, in accordance with the Privacy Policy.
• Will enable data download at any time.
• Will maintain backups for protection against data loss.

The User:

• Is responsible for the accuracy and lawfulness of all entered data.
• Confirms that they have the legal right to enter the data (including personal data of students and teachers).
• Is advised to regularly make their own backups through the download function.

All intellectual property rights related to the Application, including:

• Software code and architecture
• Design, graphics, and user interface
• Trademarks and logos ("еБиблиотека", "eBiblioteka")
• Documentation and website content

are and remain the exclusive property of the Service Provider or its licensors.

These Terms do not transfer any intellectual property rights to the User, except for the limited, non-exclusive, and non-transferable right to use the Application for the duration of the agreement.

The User may not copy, reproduce, modify, distribute, or sell elements of the Application.

The Service Provider warrants that the Application will function in accordance with its core purpose and the delivered documentation.

The Service Provider is NOT liable for:

• Interruptions caused by force majeure (natural disasters, wars, cyber attacks by third parties, etc.).
• Problems with the User's internet connection.
• Improper use of the Application by the User or their users.
• Problems with the User's hardware/software.
• The content and accuracy of data entered by the User.
• Damage resulting from unauthorized access caused by the User's negligent storage of passwords.

The maximum liability of the Service Provider for any damage is limited to the amount of the fee paid by the User in the last 12 months (for the free period: 0 denars), except in cases of intent or gross negligence.

The Application is offered "as is" during the free period, without warranties of uninterrupted operation or absence of errors, although the Service Provider will make reasonable efforts to provide a stable and functional service.

The right to use the Application may be terminated:

• At the User's request: The User may at any time request termination of use and deletion of the account by written request to info@ebiblioteka.mk.
• After expiration of the free period: If the User does not enter into a paid usage agreement (see the "Free Period" section).
• Due to violation of the Terms: The Service Provider may suspend or terminate access if the User repeatedly and seriously violates these Terms, after prior written warning and an additional period of 15 days to remedy the violation.

After termination of use:

• The User has 30 days to download all of their data.
• After the expiration of the 30 days, the Service Provider may delete all of the User's data from its systems.
• Obligations regarding confidentiality and personal data protection remain in effect even after termination.

The Service Provider reserves the right to amend these Terms of Use. For significant changes:

• Users will be notified via email at least 30 days before the changes take effect.
• Continued use of the Application after the new Terms take effect shall be deemed acceptance.
• If the User does not agree with the amendments, they have the right to terminate use and download their data within the 30-day period.

The current version of the Terms is always available on this page. The date of the last amendment is indicated at the beginning of the document.

For all matters not regulated by these Terms, the provisions of the Law on Obligations and other applicable laws of the Republic of Macedonia shall apply.

The contracting parties agree to resolve any disputes arising from or in connection with these Terms primarily through amicable settlement and mutual negotiation.

If a dispute cannot be resolved amicably, the competent court shall be the Basic Court of Берово, according to the registered office of the Service Provider.
